《民法典》立法变化对学校体育的影响主要集中在侵权责任编相关条款的内容增减上。总体来看，《民法典》相关条款的立法变化纠正了过去相关法律法规对学校体育法律关系中某些主体的过度保护，有利于学校体育的有秩开展，但受伤害学生因此陷入更加不利的境地。同时，《民法典》将面临在学校体育中适用的进一步解释、法官体育专业知识盲点和法官自由裁量权过大3项挑战。为此，需要通过司法解释来解决自甘冒险规则适用于学校体育问题，建立体育专家咨询制度来增强法官对过错认定的把握准确度，建立案例指导体系和类案强制检索制度来限制法官自由裁量权。

The impact of the legislative changes in the Civil Code on school sports is mainly concentrated on the addition and reduction of some articles in the tort liability edition. On the whole,the legislative changes in the relevant provisions of the Civil Code have corrected the excessive protection of certain subjects in the legal relationship of school sports by relevant laws in the past,which is conducive to the orderly development of school sports. But on the other hand,the injured students will therefore in a more disadvantaged situation. At the same time,the Civil Code will face the three kinds of challenge,further interpretation applicable to school sports,the challenge of the blind spot of judges' sports professional knowledge,and the challenge of excessive discretion of judges. For this reason,judicial interpretation is needed to solve the problem of applying the self-willing risk rule to school sports. Establish a sports expert consultation system to enhance judges' accuracy in determining faults,and establish a case guidance system and a compulsory search system for similar cases to limit judges of discretion.
