体育赛事版权作为媒介产品,具有事业和产业双重属性,对于社会公共利益和传媒产业发展具有重要意义。通过梳理我国体育赛事版权资源配置和利用的2个发展阶段,指出对其缺乏细分而产生的垄断、过度竞争等问题,从而导致版权资源利用效率低下。在此基础上,对商业赛事和非商业赛事进行区分和比较分析,依据主流经济学理论、传媒理论,基于我国国情,论证商业赛事版权的私人物品和非商业赛事版权的准公共物品的性质差异,提出建立和完善我国体育赛事版权资源区别配置和利用制度安排的对策建议:非商业赛事版权通过行政规制确立央视等国有转播机构的主导地位;商业赛事版权借助市场机制的优势和行业自律,各方公平参与竞争,政府进行适度的经济规制以弥补市场的不足。依据不同性质的赛事版权,通过针对性的规制,确立相应的转播主体,从而追求社会效益和经济效益的最大公约数。
Abstract:As media product,sports match copyright has dual attributes of career and industry,which is of great significance to public interest and the development of media industry. Through combing two development stages of sports match copyright resource allocation and utilization in China,we points out problems such as monopoly and excessive competition caused by the lack of subdivision and leading to inefficient use of copyright resource. On this basis it compared and analyzed commercial and non-commercial sports match. According to mainstream economics theory,media theory and China's national condition,nature distinctions between commercial match copyright as private goods and non-commercial match copyright as quasi-public goods are demonstrated. Finally,countermeasures and suggestions for establishing and perfecting the disparity allocation and utilization system arrangement of sports match copyright resource in China are put forward:Non-commercial sports match copyright-dominated by state-owned broadcasters like CCTV through administrative regulations. Commercial sports match copyright-take advantage of market mechanism and self-regulation,all parties compete fairly and the government conducts appropriate economic regulations to compensate for market deficiencies. According to the different nature of copyright,the corresponding broadcasting subject is established through targeted regulation so as to pursue the greatest common denominator of social and economic benefits.
