天津体育学院学报

目的:通过对北京奥运会期间国际体育仲裁院临时仲裁分院(AHD)所仲裁的案例进行介绍和评述,使读者更进一步了解奥运会体育争议的仲裁机制。方法:从探讨北京奥运会临时仲裁中的法律理论问题入手,采用列举的方式,对AHD裁决的案例进行分类,然后按照类别分别予以介绍并进行综合评述。结果:第29届奥运会上,AHD共受理9起案件,分别涉及参赛资格、裁判处罚程序和比赛结果争议。从最后的裁决可以看出,在法律适用以及裁决的结果方面基本上遵守了国际体育仲裁院以往判例的精神。

Objective: Through introducing and commenting the cases decided by AHD during the Beijing Olympic Games,the readers were better under-stood the arbitration mechanism of the Olympic sports dispute.Method: Beginning with the legal theories of ad hoc arbitrating at the Beijing Olympic Games,and Using the methods listed in,the cases ruled on by AHD were classified,and introduced and commented accordance with the categories respec-tively.Results: During Beijing Olympic Games,AHD arbitrated 9 disputes raised from the Games,including disputes of accreditation,complaints about the referee's decision and the results of the competition.From the decisions,as to the choice of law and arbitral results,these awards followed the fundamental spirits of the CAS jurisprudence.
