随着网络技术的发展,网民数量与日俱增,在网络上观看体育赛事转播节目已较为常见。然而,未经授权通过网络转播体育赛事的侵权行为频繁发生,这不利于体育赛事转播产业的健康发展。中国立法在体育赛事网络转播保护方面还存在很多漏洞,主要表现为体育赛事转播权的法律地位并未明确,权利内容不明;体育赛事转播节目的著作邻接权权利范围狭窄,无法规制网络盗播行为;体育赛事网络转播主体是否享有广播组织权并不确定。为此,立法需要遵循新技术的特点,明确规定体育赛事转播权,规定该权利的具体内容;完善《著作权法》中的著作邻接权制度,增设能够涵盖通过各种技术手段传播信息的转播权,规定广播组织对其播放的体育赛事节目信号享有全面的控制权;确定体育赛事网络转播主体享有广播组织权,使网络转播主体有权控制他人在互联网上转播体育赛事节目。通过上述措施,建立完整的体育赛事网络转播法律保护体系,使体育赛事网络转播这一产业链上投资的各个主体的利益能够得到妥善保护。

With the development of network technology,the netizens growing with each passing day,watching sports broadcasting programs on the Internethas been more common,however,the torts of unauthorized broadcasting sports through a network occurred frequently,this is not conducive to the healthy de-velopment of sports broadcasting industry. China's legislation in the sports broadcasting network protection have some omissions,such as the legal status ofsports broadcasting rights is not yet clear,also the right content is not clear,the range of sports broadcasts work of copyright relating rights is relatively nar-row,can't regulate the piracy behavior in the network,whether sports broadcast network subject shall enjoy the right of broadcasting organizations rights is un-certain. The legislation needed to follow the characteristics of the new technology,make clear the sports broadcasting rights and the specific content of therights,improve the system of the relating rights in the copyright law,adding the broadcasting rights that covers through various technical means to spread in-formation,stipulating the broadcasting organization have the complete control right of the sports radio program signal,the sports broadcasting network subjectwill enjoy the right of broadcasting organizations rights,the sports broadcasting network subject has the right to control other people on the Internet to broad-cast sports program. Through the above measures,establish a complete legal protection system of network sports broadcast,make the sports network broad-casting on the industrial chain of investment of each subject of interests can be properly protected.
